Attorney goes after “noisy” Police bikes in Denver

An attorney has found a novel idea of how to get the new law overturned when he pointed out that the police departments own motorcycles cannot meet the enforcement level in effect. While the police bikes are just barely over the limit, it does show how a unmodified engine and pipes can still be illegal by the new law.

It could be interesting to see the city of Denver having to ground all of motorcycles that exceed the noise limit. This would effectively kill the motorcycle division because I believe they ride Harley-Davidson motorcycles exclusively. H-D police bikes are known to be the loudest of all the bikes that are normally made into police models.

City officals are saying the lawyer is just trying to get his client off, referring to a biker that was cited because a officer used a “gut feeling” to pull him over and inspect for the EPA tag which the biker did not have.

City officals are also saying that they are not going after bikers that are near the 80 decibel limit but are after those only “considerably higher in decibel.” But it is left to individual officers without sound meters to decide in the field.

Hopefully the biker and lawyer will push to have the Denver motorcycle force grounded until they too meet the EPA standard or are forced to sell/return from lease the bikes. Maybe with that showing, it will be proven that the noise ordinace is extreme and truly unenforceable because bikers are being ticketed for subjective evaluations.
